TM Forum - Speaker Consent Form

- Purpose. You are speaking on the conference program at a TM Forum event (the “Event”), as specified in your event invitation or related materials. Your participation will be recorded by video, audio, photo, transcript, or other means (the "Recording"). TM Forum, a New Jersey Non-Profit Corporation ("TM Forum"), may broadcast, publish, and distribute the Recording for the following purposes: live event display, live streaming, on-demand replay, session highlight clips, social media distribution, website and event platform publication, press and media relations use, sales/sponsorship/partnership promotion, internal business use, and future event promotion, across any media channel, now or in the future (together, the "Work").TM Forum may use artificial intelligence and automated tools in connection with Event content, including TM Forum-developed tools and third-party or partner tools (together, “AI Services”). These AI Services may process session content and your contributions to support event delivery and related purposes. For illustration, AI Services used at the Event may include:
- AI Agent Panelist (TM Forum): TM Forum and its partners may use your voice and likeness to power AI tools that process session content and may participate in or simulate discussions at the Event ("AI Agent Panelist"). The AI Agent Panelist activities will include real-time summarization during the session, post-session summarization, topic and keyword extraction, quote extraction (subject to human review prior to publication), content tagging and metadata generation, search and retrieval within event content, Q&A assistance based on the session, multi-language translation, processing session content and generating outputs for event-related purposes, including summarisation, extraction and analysis. This processing does not include training, fine-tuning or improvement of AI models using personal data from the Event. The AI Agent Panelist may automatically summarize, extract, and reuse your contributions, but will not be used for voice cloning, synthetic persona generation, biometric profiling, or any automated decision-making that produces legal or similarly significant effects.
- Transcription Services: TM Forum may use transcription, captioning and related technology services to generate live or post-event transcripts, captions, summaries and other text-based records of Event sessions. These services may process your voice and spoken contributions for Event-related purposes, including identifying speakers in transcripts where this functionality is enabled. Where speaker identification functionality relies on the processing of unique voice characteristics, such processing may constitute biometric data processing under applicable data protection laws. By indicating your acceptance of this form, you expressly consent to such processing for the limited purpose of identifying and attributing speakers within Event transcripts and related records.
- License. In exchange for the opportunity to participate in the Event, you grant the following rights:
- Recording and Processing: You give TM Forum and its employees, contractors, agents, and service providers acting on TM Forum's behalf the right to make the Recording of your presentation and participation (the “Presentation”), and to use your voice, speech patterns, and contributions from the Recording to support AI Services (including the AI Agent Panelist and similar tools), including for automated summarization, extraction, or reuse in AI or machine learning workflows ("AI Processing", meaning processing carried out by AI Services). “AI Processing Outputs" means any summaries, transcripts, captions, translations, extracts, metadata, tags, search results, analyses, reports or other content generated by AI Services from or in connection with the Recording.
- Distribution: You give TM Forum the right to use, reproduce, adapt, and distribute the Recording, the AI Processing, the Work, and any AI Processing Outputs, including your name, image, likeness, voice, and statements, permanently, worldwide, and in any format, for the purposes described in Section 1, without asking you again or paying you. TM Forum is not required to use the Recording or AI Processing.
- Speaker Warranties.You represent and warrant that:
- You have all necessary rights, licenses and permissions to provide the Presentation and any materials used in connection with it;
- the use of the Presentation and such materials by TM Forum in accordance with this Form will not infringe the intellectual property or other rights of any third party; and
- any third-party materials included have been properly licensed or authorized for such use.
- Ownership. You keep ownership of your original presentation materials, and you may share or repost the Recording for personal or professional use without TM Forum's permission. TM Forum owns the Work, the Recording, and any AI Processing Outputs created by or for TM Forum, including all related intellectual property rights. TM Forum only gets the rights specifically listed in this form.
- Claims. To the maximum extent permitted by applicable law, you agree not to bring legal claims against TM Forum or its officers, employees, agents, or representatives arising from their use of the Recording, AI Processing, AI Processing Outputs, AI Agent Panelist, or your name, voice, likeness, or image in connection with the Work. This includes claims for copyright infringement, right of publicity, defamation, or misrepresentation. Nothing in this section limits or waives any statutory or data protection rights that cannot be waived under applicable law.
- Voice Data. This section describes how your voice data may be used in connection with the AI and transcription services described in Section 1.
- TM Forum (AI Agent Panelist): TM Forum may collect, store, and use your voice data to support AI Services (including the AI Agent Panelist) for event-related purposes, including session interaction, summarisation and analysis. This processing does not include training, fine-tuning or improvement of AI models using personal data from the event. TM Forum will delete its own copies of your voice data no later than 90 days after the Event, unless it is required by law to keep it longer. For clarity, shorter retention periods may apply to transcripts, logs and AI-generated outputs in accordance with TM Forum’s contractual and operational data retention requirements.
- Transcription Services: TM Forum may use third-party or partner transcription, captioning and related technology providers to support Event delivery and publication. These providers may process your voice and spoken contributions to create transcripts, captions, summaries or other text-based records of Event sessions, and, where enabled, to identify or tag speakers within those records. Where speaker identification functionality relies on the processing of unique voice characteristics, providers may process voiceprint data or similar identifiers which may constitute biometric data under applicable data protection laws. By accepting this form, you expressly consent to such processing for the limited purpose of recognising, identifying and attributing speakers within Event transcripts and related records. TM Forum will require such providers, by contract, to process voice and voiceprint data only for these purposes and to delete or de-identify it within a reasonable period following the Event, and in any event no later than 90 days after the Event unless required by law to retain it longer.
- Any such processing will be carried out for Event-related purposes and in accordance with TM Forum’s applicable contractual, operational and data protection requirements. You may withdraw your consent or exercise any applicable data protection rights at any time by contacting TM Forum at [email protected]. Any such withdrawal will take effect prospectively only and will not affect (i) the lawfulness of processing carried out before withdrawal or (ii) TM Forum’s continued use of any Work, Recording, or AI Processing Outputs already created, as licensed under Section 2. This section continues to apply after this agreement ends.
- Governing Law. This Form is governed by the laws of England and Wales. Any disputes will be handled exclusively by the courts of England and Wales. References in this form to data protection laws mean the UK GDPR and the Data Protection Act 2018 and, where applicable to the Event or your location, the EU GDPR and any other applicable data protection laws.
- Acceptance. By ticking the acceptance box, submitting the relevant Microsoft Form, or otherwise confirming your agreement through a registration, onboarding or event check-in process made available by TM Forum, you confirm that you have read and agree to this Speaker Consent Form.
